Is Delta 9 THC Legal In Washington?

Is Delta 9 THC Legal In Washington?

After the 2018 Farm Bill was passed in the US, hemp and hemp-derived products became legal countrywide. It is time for those who have been waiting for this moment. Yes, Delta 9 THC is legal in Washington, but with some regulations and bans on certain product categories.

Do you know what exactly Delta 9 THC or D-9 is?

D-9 or Δ⁹-tetrahydrocannabinol is derived from hemp, not marijuana, and contains no more than 0.3% or less of THC by dry weight. This meets with the 2018 Farm Bill, which established guidelines for how much THC should be included in a product sold in a store. D-9 is added to sugary gummies and other edibles, making it theoretically legal to sell under certain restrictions.

What should you know?

The LCB—Washington State Liquor and Cannabis Board issued a notice regarding all doubts and questions surrounding Delta 9

The LCB stated:

Within the legal cannabis market, cannabis processors cannot turn hemp-derived CBD into delta-9 psychoactive substances. Processors who engage in these activities may face body violations or disciplinary action.”

This means

Licensed cannabis processors are prohibited from selling or purchasing any psychoactive drug product that has been legally manufactured by a licensed cannabis grower. Although the LCB’s interpretive/advisory statements are not laws, they do help to clarify the LCB’s interpretation of its governing statutes and laws. The LCB’s ability to target infractions of those rules remains to be seen, but for the time being, the LCB aims to enforce the difficulty from an “education-first viewpoint” to help licensees in achieving compliance.

Therefore, according to the Washington State law:

Delta-9 is only available in oils, tinctures, edibles, and other hemp-derived goods. On a dry weight basis, D-9 THC levels in all CBD products must not exceed 0.3 percent.
