On July 19, Governor of Oregon, Kate Brown, signed HB 3000, an omnibus bill based on Oregon’s hemp production into law. HB 3000 contains several changes, but one aspect of the bill that could have a big impact on how Delta-9 THC products are sold in Oregon. It replaces the old classification of cannabis and cannabis products into marijuana or hemp with a new, overarching classification known as ‘Adult-Use Cannabis and Cannabinoids items.’

Adult-use cannabis and cannabinoids items

HB 3000 introduces a new classification of cannabis under Oregon law called “Adult Use Cannabinoids” which is specified to include the following:

  • Tetrahydrocannabinol
  • Artificially or naturally produced tetrahydrocannabinolic acids
  • Delta-8 THC
  • Delta-9 THC
  • Optical isomers of D-8-THC and D-9-THC, respectively.
  • Any cannabinoid generated artificially that has been determined to have an intoxicating effect.

HB 3000 also provides a new classification of consumer products. The following items are considered “Adult-Use Cannabis Item”:

  • A hemp item (products containing hemp sold in the recreational and medical markets in Oregon), and
  • A concentration of Adult Use Cannabinoids to be determined by the OLCC, in consultation with the OHA and the ODA, or a concentration of D-9 THC that exceeds 0.3% on a dry weight basis, or the federal law’s threshold if any of those changes.

Under HB 3000, it is illegal to sell an Adult Use Cannabinoid Item to anybody under the age of 21.
